SMS Campaign Terms of Use

These SMS Campaign Terms of Use ('SMS Terms') govern your participation in SMS text message campaigns operated by Vetigen, Inc. ('Vetigen', 'we', 'us', or 'our') and veterinary clinics using our platform.

By opting in to receive SMS messages, you agree to be bound by these SMS Terms.

Your opt-in to receive SMS messages constitutes your acceptance of these SMS Terms. If you do not agree to these terms, do not opt in to receive SMS messages.

These SMS Terms supplement our general Terms of Service and apply specifically to SMS campaign participation.

Our SMS campaign service allows veterinary clinics and pet owners to communicate via text messages. The service includes:

• Appointment reminders and confirmations
• Promotional offers, discounts, and special announcements
• Pet health tips and educational content
• Clinic news and service updates
• Important alerts and notifications

To participate in our SMS campaigns, you must:

• Be at least 18 years old or have parental consent
• Have a valid mobile phone number capable of receiving SMS
• Provide express consent to receive messages
• Have authority to agree to charges that may apply

You may opt in to receive SMS messages through the following methods:

• Checking the SMS consent box on our website forms
• Enabling SMS notifications in the PetConnect app
• Providing written consent at a veterinary clinic
• Texting a keyword to our short code

After opting in, you will receive a confirmation message. Standard message and data rates may apply.

You may opt out of SMS messages at any time. We provide multiple opt-out methods:

Message frequency varies based on your preferences and the campaigns you've subscribed to. On average, expect 2-8 messages per month.

Messages are sent during appropriate hours (typically 8 AM - 9 PM in your local time zone). Urgent alerts may be sent outside these hours.

Vetigen does not charge for SMS messages. However, standard message and data rates from your mobile carrier may apply.

Check with your carrier for details about your messaging plan. You are responsible for any charges incurred.

As an SMS campaign participant, you agree to:

• Provide accurate and current phone number information
• Notify us promptly if your phone number changes
• Not misuse the SMS service or share opt-in codes improperly
• Comply with all applicable laws and regulations

You may not use our SMS service to:

• Engage in any illegal or fraudulent activity
• Opt in numbers you do not own or control
• Provide false information to receive messages
• Attempt to interfere with message delivery systems

While we strive for reliable message delivery, we cannot guarantee:

• Messages will be delivered to all recipients
• Messages will arrive without delays
• Third-party carrier networks will function properly

SMS messages should not be relied upon for emergency communications. In case of a pet emergency, contact your veterinarian directly.

To the maximum extent permitted by law, Vetigen shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in SMS campaigns.

Our total liability shall not exceed the amount you paid to Vetigen in the twelve months preceding the claim, if any.

We reserve the right to modify these SMS Terms at any time. Material changes will be communicated via SMS or other appropriate means.

Your continued participation in SMS campaigns after changes constitutes acceptance of the modified terms.

We may terminate or suspend your participation in SMS campaigns at any time for violation of these terms or for any other reason at our discretion.

You may terminate your participation at any time by opting out as described above.

These SMS Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

Any disputes arising from these SMS Terms shall be resolved in the courts of Delaware.
